Post-2018 Farm Bill & Hemp: Understanding the Regulatory Landscape of an Unregulated Industry

The recent passage of the 2018 Agricultural Improvement Act, commonly referred to as the 2018 Farm Bill, has drastically transformed the regulatory landscape allowing for the mainstream cultivation of hemp along with the unrestricted sale, transfer, transport, and possession of hemp and hemp-derived products. While the 2018 Farm Bill removed hemp-derived products from the DEA’s Schedule I Status under the Controlled Substances Act thereby allowing for the broad commercial availability of CBD and hemp-derived products, this federal legislation does not legalize the production of CBD and hemp-derived products in existing state systems, leaving each state to develop their own regulatory framework to address the cultivation, production, processing, testing, marketing, and transportation of this new agricultural commodity.  

In the post-2018 Farm Bill era with non-existent or limited regulatory oversight and guidance, how does the hemp industry thrive while remaining compliant when state regulatory agencies are still building out the infrastructure to regulate our industry without support or direction from their federal partners? Join me to learn more about how to proactively adopt existing regulations to comply with food safety, marketing & labeling, fire & life safety, and occupational health & safety standards as well as understanding how testing and pursing recognized accreditations and certifications can help build consumer confidence in your brand.
